You must pay a fine of NOK 12.900

The 33-year-old pleaded not guilty when he appeared before the Stavanger District Court. The reason the case was taken to court is because he received a summons for using a mobile phone while driving on February 13 this year, which he refused to accept.

The court used the police officer’s statements as a basis for evaluating the evidence.

He explained that he and his colleague lined up at Stingata in Stavanger for an examination. From where they were lined up, they had an elevated position and a good view of the cars passing by. The police officer explained that he noticed that the accused was holding a mobile phone in his right hand, that it was lit, and that his thumb was moving over the mobile phone. When the police stopped the accused and approached him, the witness’s partner saw that the mobile phone was in the passenger seat and was playing a movie clip. The defendant did not want to accept the order immediately because he thought it was too expensive. He also had no reliable explanation for what the police officers might have seen. “Based on a comprehensive evaluation of the evidence, the court found that it could exclude the defendant’s explanation during the main hearing that he did not use a mobile phone while driving,” the ruling said.

Regarding the sentence, the court found no aggravating or mitigating circumstances and sentenced the 33-year-old to pay a fine of NOK 8,900.

In addition, he was also ordered to pay NOK 4,000 in court costs to the public.
