New rules for selling cars:
Two of Norway's biggest car dealers are selling cars illegally. – Both Sulland and Mobile are expected to remain more up to date, says NAF.
Since the beginning of the year, the consumer purchasing law has been changed. One of the most important improvements for car buyers is that it is no longer permitted to sell cars with general reservations, such as being sold “as is,” “as is,” or in English, “as is.”
The reason for imposing the ban is that buyers of cars that were sold with general reservations have a weaker position if a conflict arises during the complaint period.
But a month and a half after the new law was passed, it has become very easy to find car dealers who are still advertising cars with these reservations.
Motor examined a number of advertisements from large and small car dealers. We found no listings with bookings from major traders, such as Møller Bil and Bertel O. Steen.
However, we have come across ads from Sulland and Mobile. The brand dealers, which have several car dealerships in Norwegian cities and towns, are among the top 10 brand dealers in the country.
– Lack of knowledge
Mobile company in Sarpsborg advertises Mini Clubman with text
“Sold as is”while Sulland in Mysen sells a Toyota Rav 4 with the text:
“We sell it as is” cheap car ” With errors and omissions.
– There may still be a lack of knowledge among sellers about changes in consumer purchasing law. But we should expect big retailers like Sulland and Mobile to stay more up to date on the latest developments, says Vigdis Svennungsen of NAF Advokat, who has reviewed a number of Motor's ads.
She adds:
– The same applies to other dealers who are members of the Automobile Industry Association, who themselves declare that membership provides greater security.
Advertising texts
We have found illegal advertisements from a number of brand name dealers and several used car dealers.
Among others are Mazda and Hyundai dealer Strandveien Auto in Trøndelag, which sells the Nissan Qashqai. “As is”And from the used car dealer Os Bilsenter, which sells the Volkswagen Amarok “like ice”.
Sande Auto, a brand dealer for several car brands in Western Norway, sells a Peugeot 207 with text “As without a status report, with reduced possibility of complaints and without a guarantee.”.
Sorry
When Motor Company asks dealers, most are quick to change their advertising.
– Obviously, we are interested in following established rules and guidelines. A little went wrong here, writes sales manager Daniel Selevage at Sande Auto.
– The text was entered by mistake, says General Manager Pål Tunem Olaussen at Mobile Sarpsborg.
“This is just an oversight,” says Stage Forum sales manager at Strandveien Auto.
General Manager Daniel Grebe at Os Bilsenter says that they forgot to update the advertisement and that they have now stopped selling cars with reservation.
– a surprise
Vigdis Svenungsen, president of NAF Advokat, NAF's law firm, was surprised by the many disclaimers in sales ads.
– Yes, it's a bit surprising, she says – and points in particular to Saland's announcement.
Soland is selling his Toyota RAV4 with the ad stating “without any form of warranty or right of complaint.”
– It does not comply with the provisions of the Consumer Purchase Act, which Soland should know better, says Svenungsen.
Does not change
Unlike other dealers requested by Motor, Sulland Indre Østfold in Meissen has no intention of changing the ad text.
-We have one car with this text on it, a popular model that a lot of people want. This is done preventatively, so that you don't get all kinds of inquiries about the car, and so that people understand what they are buying, managing director Tor Engom tells Motor.
He adds that the buyer would have the right to file a complaint in any case.
– He says: We cannot put ourselves above the law.
– But why do you write that you have no right to complain?
– Because then a lot of people think “I don't want that car.” The car is a few years old and has covered a few hundred thousand kilometers.
-So you don't want to change the ad text?
– no.
More changes
The law changes:
Learn why car buying is safer
The ban on the sale of publicly reserved cars is just one of several changes to the Consumer Purchasing Act, which came into effect at the turn of the year.
Motor has written many articles about changes that will make buying a car and other things safer.
Amending the law:
Now it's safer to buy cars
Here is a longer article and here is one Shorter article.
watch out!
If you are considering purchasing a car that contains general reservations in the ad text, you must ensure that they are written correctly in the sales contract.
But if you have purchased a car with such reservations also in the contract, it is important to know that the reservation is invalid and therefore will most likely have no say in a complaint or lawsuit.
– In our opinion, such a clause will not be taken into account and will have no effect in cases where the new consumer purchasing law applies, says Vigdis Svennungsen at NAF.
